Terms of use

These terms apply to the Keep86 app, the keep86.com website and your Keep86 account. We have written them in plain language. Where the law of your country gives you more rights as a consumer, those rights always apply.

1. Who we are

Keep86 is provided by [LEGAL ENTITY], [LEGAL ADDRESS], company number [COMPANY NUMBER], VAT ID [VAT ID] (“we”, “us”). You can reach us through the contact form on this website or at hello@keep86.com.

2. What Keep86 does

Keep86 runs a hidden macOS 27 virtual machine on your Apple silicon Mac and shows the windows of Intel-only apps installed in it on your desktop. Keep86 does not include macOS or any third-party app: macOS 27 is downloaded from Apple at your request, and you install your own apps with your own licences.

3. Personal, non-commercial use only

3.1 Apple’s macOS software licence agreement allows you to run up to two additional copies of macOS in virtual machines on a Mac you own or control, for specific purposes that include personal, non-commercial use. Keep86 is therefore licensed only to individuals, for personal, non-commercial use. You may not use Keep86 for business, professional or commercial purposes, or on behalf of an organisation.

3.2 You are responsible for complying with Apple’s licence for macOS and with the licences of the apps you install in the virtual machine. We are not affiliated with Apple Inc.; Apple, Mac, macOS and Rosetta are trademarks of Apple Inc.

4. Your licence to use Keep86

4.1 While you have an active trial, subscription or a version you keep under section 7, we grant you a personal, non-exclusive, non-transferable licence to install and use Keep86 on one Mac at a time.

4.2 You may not share your licence key, resell Keep86, or bypass, disable or tamper with its licence checks. Rights you have by law (for example to make a backup copy or to study how the software works where the law allows it) are not limited by this section.

4.3 You can move your licence to another Mac you own up to twice in 30 days, in the app or in your account; for further moves, write to us. We email you whenever your licence is activated on a Mac it was not active on, with a link to remove that Mac if it wasn’t you.

4.4 If we see clear signs that a licence is shared with or resold to other people (for example several Macs taking turns, or use from several countries at the same time), we may suspend it. A person reviews every suspension and you can always explain your situation. If sharing or resale is confirmed, we may revoke the licence without a refund. 5. Free trial

You can try Keep86 for 7 days, free and without payment details. The trial needs a working email address and is available once per Mac and per email address. At the end of the trial, kept apps no longer open through Keep86 until you choose a plan. Nothing on your Mac is deleted.

6. Plans, prices and payment

6.1 Plans: monthly, 6 months and annual. Current prices are shown on the pricing page and include VAT. The price you agreed to applies to your current period; if we change prices, we tell you by email at least 30 days before your next renewal, and you can cancel before it.

6.2 Payments are processed by PayPal. Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time from your account page or in PayPal; your plan then runs until the end of the period you paid for.

6.3 If a payment fails, Keep86 keeps working during a grace period (7 days for monthly, 14 days for 6-month and annual plans) while PayPal retries.

7. Keep your version

7.1 6-month and annual plans: when your paid period and grace period end without renewal, you may keep using the last version of Keep86 released before your paid period ended, on the Mac where it is activated. You no longer receive new versions, compatibility updates or support.

7.2 Monthly plan: Keep86 stops opening kept apps after the paid period and grace period end.

7.3 Keep-your-version does not apply if your payment was refunded, reversed or subject to a chargeback, or if the licence was revoked under section 9.

8. Compatibility and availability

8.1 We test apps and publish results in the compatibility database, but we cannot guarantee that a particular app works in Keep86. Known limits — for example apps that need OpenGL, Mac App Store sign-in, drivers or 32-bit code — are described on the website. Please use the free trial to check the apps you need before you pay.

8.2 Keep86 depends on technologies provided by Apple. If Apple changes macOS or its hardware in a way that stops Keep86 from working, we will tell you, and you can cancel. [LEGAL REVIEW: treatment of prepaid periods in that case]

9. Ending the agreement

You can stop using Keep86 and delete your account at any time. We may suspend or end your licence if you seriously breach these terms (for example by sharing licence keys or using Keep86 commercially), after telling you why where the law requires it.

10. Your statutory rights and our liability

10.1 If you are a consumer in the EU, you have the statutory rights for digital content and digital services, including the right to have Keep86 brought into conformity. Your right of withdrawal is explained on the refunds page.

10.2 We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law says so. Otherwise our liability is limited to foreseeable damage typical for this kind of contract. [LEGAL REVIEW: liability clause for the seller’s jurisdiction]

10.3 Keep your documents backed up. Keep86 moves documents to the Trash rather than deleting them when you remove it, but no software is free of faults.

11. Changes to these terms

We may change these terms for valid reasons (for example new features or legal changes). We tell you about important changes by email at least 30 days before they apply; if you don’t agree, you can cancel before then.

12. Law and disputes
